The WSBA International Practice Section encourages you to attend the Asia Business Forum's (ABF) first meeting on January 31 (Tue) at the office of Davis Wright Tremaine, 1201 Third Avenue, Suite 2200, Seattle, WA.

The ABF is a forum for professionals in the Greater Seattle Area, who are engaged in work related to Asia or interested in Asian economies, to share knowledge, ideas, experience and expertise. The ABF hosts a 90-minute forum six times a year in Seattle and Bellevue, which is open to the public (but no CLE).

Title: "FINDING MONEY: INTERNATIONAL ASSET SEARCH AND RECOVERY METHODS FOR COLLECTING JUDGMENTS"

Description: Join Juval Aviv, President & CEO of Interfor , Inc., an international corporate intelligence and investigations firm as he discusses issues pertaining to the enforcement of judgments in and outside of the United States. In order to effectually enforce an obtained judgment, counsel must be familiar with certain methods and procedures that may be nontraditional or non-domestic – outside a lawyer’s usual problem-solving ‘tool box’. Such methods are especially apropos when enforcement of US judgments may be carried out overseas, where it is often easier for defendants to hide assets and/or make them unavailable through fraudulent conveyances to controlled trusts and nominees. A plaintiff with a reasonable expectation of a judgment for damages in the US can take steps in anticipation of enforcement of the judgment by obtaining an attachment of the defendant’s assets, which could include those assets kept in and outside of the United States. Many countries, in Europe and elsewhere, permit separate proceedings for these prejudgment attachments (or the functional equivalent thereof) to be brought in their courts for the purpose of holding the assets as security. Both the English Commonwealth jurisdictions and Switzerland afford creditors opportunities to make use of attachments and obtain information for the enforcement of judgments.

RESPONDING TO HAITI”

Topic/Speakers:

Join Brian Concannon Jr., Esq., the Director of the Boston based Institute for Justice & Democracy in Haiti (IJDH), and Coordinator of the Lawyers' Earthquake Response Network as he discusses the international legal response to the earthquake in Haiti, including legal work conducted in both Haiti and the United States. The CLE will discuss the extreme mortality of the earthquake, to a large extent the result of inadequate development of the rule of law in Haiti, and of intentional policies implemented by the Haitian government and the international community. Mr. Concannon will also discuss both short-term efforts to enforce the rights of earthquake victims and longer-term efforts to build the stability necessary for Haiti to become less vulnerable to the next natural disaster.

Mr. Concannon lived in Haiti for nine years, working for the United Nations and the Bureau des Avocats Internationaux (BAI), Haiti’s largest and most experienced public interest law firm.

Attendees at this interesting CLE will gain an understanding of:
1) Expanding U.S. immigration opportunities for Haitians;
2) The legal obligations of donor states under human rights law;
3) Responding to an epidemic of rapes in the IDP camps; and
4) Enforcing rights of internally displaced people in Haiti.

On October 14, 2010, the World Affairs Council will also be hosting Brian Concannon as part of its Focus on Haiti Series. Mr. Concannon’s lecture entitled Building Haiti Back More Justly – A Human Rights-Based Approach to Earthquake Response will be held at the University of Washington – Williams H. The 2010 IPS AGM: A Wonderful Success!

Approximately 30 WSBA International Practice Section (IPS) members and guests boarded The Seeker of Anchor Bay Charters for our AGM, which took place amidst a 3-hour tour of Lakes Union and Washington.

Although the day started out cloudy and cool, by the time came around to set sail, the sun broke, the clouds dissipated, and a full-on blue sky evening resulted. Thus, once again, our AGM was enhanced by great summer weather, fabulous food from Mangetout Catering, chilled beverages, stimulating and lively debate, and entertaining conversation.

We held our annual meeting, which elected our new Executive Committee (EC) for 2010-2011: Glen Yaguchi as Chair, Charles Rendina as Chair-Elect, Krista Wittman as both Secretary and Treasurer, Randy Aliment as EC position #3 (2010-2013). We also welcomed one new IPS member to our EC: Bonnie Wasser - one of our speakers from last August's International Express CLE - who was also elected to Executive Committee position #4 (2010-2013).

May 12th Afghan CLE a Success!

Last week - on Wednesday May 12, 2010 - the WSBA IPS held an evening Afghan CLE entitled Afghanistan: A Changing Legal Terrain at Perkins Coie, in conjunction with JAMS Arbitration, Mediation, and ADR Services. This event was also co-sponsored by the University of Washington School of Law's Asian Law Center. Professor Jonathan A. Eddy, Director of the Asian Law Center and Manager of the Afghanistan Legal Educators Project, served as the moderator for this event.

Topics discussed included rule of law, how the legal systems (including Sharia law) differ from that of the United States, the existence of Afghan judicial independence, human rights (specifically the rights of women), and the investment situation in Afghanistan. A total of six panelists - Wahidullah Amiri, Hussain Ali Atefi, Mohammad Bashir Mobasher, Humayoun Rahimi, Mohammad Faridon Sorush, and Mohammad Ayub Yusufzai - formed a very informative and frank panel on the issues facing Afghanistan today.

The Afghan menu - made up of Bolani, Jan-i-Amma, Ashak (pasta), Breast of Chicken Kebab, Mushroom Qorma, Cucumber Salad, Baklava, and Chai Tea - were hors d'oeuvres catered by the Afghanistan restaurant Kabul and were very well received.

. How do these issues impact U.S. companies as they seek to participate in major infrastructure projects? Please join us as we explore this topic with Afghan legal scholars and practitioners, and hear from them as they share their experiences, knowledge and challenges in this ever changing terrain. The scholars will specifically discuss the challenges to creating an attractive investment climate in

Afghanistan

, commenting on issues such as security, corruption, barriers to entry, a non-transparent legal environment and an unpredictable environment.

The Afghan legal scholars and practitioners are participants in a U.S. State Department Program, and sponsored by the University of Washington Asian Law Center helping to build the “pipeline” for a new generation of Afghan lawyers, judges and prosecutors. The scholars arrived here in Seattle from Afghanistan in March 2010, and will be returning soon, so this is your last opportunity to hear their fascinating presentations!

Panel of Speakers:

Wahidullah Amiri is a graduate of Nangarhar University from the Law and Political Science Faculty. He has interned with the Nangarhar Provincial Council, providing legal counsel and promoting the National Democratic Institute. He also worked with the Afghanistan Rule of Law Project as a legal English trainer at Nangarhar Univeristy. He joins the student body as a Fulbright Scholar focusing on humanitarian and human rights law. He speaks Pashto, Dari, Urdu, English and German.

Hussain Ali Atefi is a graduate of Balkh University. While studying, he was involved in the Taawon Cultural Association and the Afghan Council Guarding Freedom and Social Justice. He looks to focus on course work in constitutional law, administrative law and international law. He is interested in researching the intersection of human rights and social justice. He speaks Dari and English and some Urdu.

Mohammad Bashir Mobasher is a graduate of Kabul University’s Faculty of Law and Political Science. He is interested in public policy, human rights, and integrating Afghan cultural values into current development projects in Afghanistan.

Humayoun Rahimi is a professor on the Law and Politics faculty at Balkh University in Mazar e-Sharif, Afghanistan. He specializes in commerce law, private international law, contemporary legal systems and criminology. He is continuing coursework at the University of Washington School of Law towards his LLM degree.

Lutforahman Saeed is a professor on the Shari’a (Islamic Law) faculty at Kabul University in Kabul, Afghanistan. He specializes in Islamic Studies, philosophy and comparative religions. He works as a legal advisor and interpreter for the US Army and is a member of the independent Bar Association of Afghanistan. He speaks Pashto, Dari, Arabic, Urdu and English.

Mohammad Faridon Sorush is a professor and the former acting Dean of the Faculty of Law and Political Science at Herat University in Herat, Afghanistan. He specializes in criminology and international organizations. He directs the legal clinic program at Herat University which he was instrumental in creating. Herat University’s clinical program, the first in Afghanistan, offers clinics in street law, civil legal advice and criminal defense. Professor Sorush is a returning participant in the Afghan Legal Scholars program.

Mohammad Ayub Yusufzai is a member of the Faculty of Law and Political Science at Balkh University in Mazar e-Sharif, Afghanistan where he teaches constitutional law, the Afghanistan constitution, human rights, and political and administrative terminology (in English). At UW, he would like to study comparative law, US constitutional law, and constitutional law. He has also worked as a counselor at the Norwegian Refugee Council. He speaks Dari, Pashto and English.

Attendees at this interesting CLE will gain an understanding of the following:
- The basic history and sources of Afghan Law;
- The interplay of Sharia (Islamic) law with the civil/criminal codes of Afghanistan;
- An overview of the Afghan legal process, procedures, and system; and
- The government contract system in Afghanistan and restrictions on foreign participation.

On March 31st, 2010, the WSBA International Practice Section held a lunch time CLE on International Arbitrations at our sponsoring firm, Williams Kastner. Facilitated by JAMS Arbitration, Mediation, and ADR Services, this very informative CLE was presented by two very interesting and engaging speakers: Jim Nagle and Doug Oles of Oles Morrison Rinker & Baker LLP.

This CLE dealt with the ins, outs, and
pitfalls of international arbitrations. Both Jim and Doug were entertaining as well as effective in highlighting the critical aspects of arbitrations in the international realm.

Last month's Foreign Lawyers Reception - held on February 25th - was a wonderful success. Williams Kastner was overflowing with attendees, both local and foreign lawyers alike (and a few internationally-inclined law students, as well).

Keynote Speaker Mr. Paul Mutty - Vice President, Assistant General Counsel, Global Commercial, of Starbucks - was both enlightening and entertaining. He highlighted how instrumental both international law and the lawyers who practice it were to making global companies like Starbucks possible.

The food - catered by Joanie's Catering - was both internationally-themed and tasty.

All in all, it was one terrific event - hope to see you all (again) next year!

February 24th CLE a SUCCESS!

Our February 24th CLE - Information Technology Act of India (ITA) and its Implication for U.S. Companies - presented by Amrita Srivasta, Principal Attorney of Auxilium Law - was a success.

Amrita focused her CLE presentation on 1) data protection laws under the ITA; 2) practice tips for companies outsourcing services to India, and 3) enhanced government powers under the ITA over intermediaries (e.g., companies such as Microsoft and Yahoo) to order monitoring, blocking, and decryption of online information.

This event, held at Williams Kastner, was well-attended.

Good Times: Our 6th Annual Law Students Reception

Our 6th Annual Law Students Reception, held at Williams Kastner on November 5th from 5:30 p.m.-7:30 p.m., was both fabulous and informative. Both section members and law students alike - and some who were both (hint, hint) - attended the event.

Attendees got to take home breath mints complete with The Global Gavel logo and website address.

We even had two law students all the way from Gonzaga Law School - kudos to them both for attending!

The event was well attended and a good time had by all....

In addition to some terrific hors d'oeuvres and beverages and an opportunity for WA law students interested in international law to network with lawyers of the WSBA International Practice Section, was a unique and valuable opportunity to hear from Ms. Karen Summerville, principal at Legal Career Management. In her very informative presentation, Karen discussed how to find success and satisfaction in the law - whether international or not - upon graduation from law school.

Our CLE on The Hague Convention: Laws of International Child Abduction, held at Williams Kastner on October 22nd, 2009 was a success.

Speaker Ramina Dehkhoda-Steele - partner-in-charge of the Seattle office of the international law firm Adorno & Yoss and a litigator with a focus on employment law, corporate and business law, real estate and family law - navigated the attending attorneys through international child custody laws and thier enforceability within the United States under The Hague Convention.

Ms. Karen Summerville's international legal background includes the study of law in Germany and acting as a referral attorney for the German Consulate when still in practice. She was a partner in the law firm Betts, Patterson & Mines, where her focus was on commercial litigation and where she was active in associate hires and training. She was also an associate with Williams, Kastner and Gibbs, where she was also a member of the hiring committee.

Prior to forming Legal Career Management, Ms. Summerville was Vice President, Client Relations with Lee Hecht Harrison, one of the largest outplacement and career-consulting firms in the U.S. She is a graduate of the University of Washington School of Law, where she was Managing Editor of the Washington Law Review. She also served as the Interim Director, Career Services in 1995.

Ms. Summerville presents frequent workshops on career management for lawyers and law students. Her column, "Managing Your Legal Career," is featured in the King County Bar Bulletin.

The Gavel Welcomes its New SLC for 2009-2010!

As our outgoing Student Liaison Correspondent (SLC), Braden Pence, heads into his third year, The Global Gavel welcomes Mr. Brandon Chan as our newest SLC.

Born and raised in Singapore, Brandon moved to the U.S. with his family at age 16. He graduated from UW with a B.A. in Business Administration in 1998. He then served in the United States Navy for four years as a Firearms instructor and Navy Rescue Swimmer, during which time he was deployed for resupply missions in the Arabian Sea during Operation Enduring Freedom. After the military, Brandon worked for a time in managerial positions in the parking and temporary labor industries.

Brandon started at the Seattle University Law School in 2007, with focus areas in International and Criminal Law. He externed for the King County Prosecuting Attorney's Office during the Summer of 2007 and is currently a research assistant for Professor Ronald Slye (Kenyan Truth and Reconcialiation Committee) on the subjecgt of international criminal law and Kara Philips (SU Law Librarian) on the subject of Chinese property law. Other achievements include winning 1st place in the Mock Trial Competition.

Our Train CLE a SUCCESS!

Our August 28, 2009 "International Express" Cross-Border Train CLE was a success! Co-sponsored by the WSBA and the WSBA International Practice Section, the first portion of this CLE was held in an Amtrak train car as it traveled north from Seattle, WA to Vancouver BC.

The second portion of this CLE, along with a post-seminar reception, was held in Vancouver, BC, Canada and hosted by the Boughton Law Corporation.

Attendees at this very unique and never-before attempted all-day CLE gained a better understanding of such issues as: the cross-border similarities and differences of the doctrines of privilege and work product; labor & employment issues for U.S./Canadian businesses entering Canada/the U.S. respectively; immigration considerations when crossing the 49th Parallel; and tax concerns, lending issues, and cross-border secured transactions.

Without a doubt, this literally international seminar offered 6.5-CLE credits for Washington Attorneys (with 1.5 of those credits ethics credits) and was a first - truly an innovative and cutting-edge international seminar.

Approximately 40 WSBA International Practice Section (IPS) members and guests boarded The Seeker of Anchor Bay Charters for a 3-hour tour. Yes, you read correctly: a 3-hour tour (fear not if you hear the theme song to Gilligan's Island - we all seem to).

We held our annual meeting which elected our new Executive Committee (EC) for 2009-2010: Jacqueline Pruner as Chair, Glen Yaguchi as both Chair Elect and Treasurer, and Gilberto Alonso Gomez Arce as Secretary. We also welcomed three new IPS members to our EC: Anamaria Turlea, Max Yoshimura, and Alvaro Alvarez, who were also elected to Executive Committee positions #1, #2, and #5, respectively. Bernel Goldberg was thanked for his wonderful leadership and insight as Chair for the 2008-2009 year and will now serve as Ex-Officio in 2009-2010. Randy Aliment, Charles Rendina, and Shahzad Qamer Qadri remain on the EC in Positions #3, #4, and #6, respectively.

The WSBA International Practice Section and the Environmental and Land Use Section are co-sponsors of the following CLE:

International Water Law
Daniel Seligman, attorney-at-law in Seattle, will discuss a recent study, World's Major Rivers: An Introduction to International Water Law with Case Studies, published by the Colorado River Commission of Nevada. The report summarizes treaty provisions on 15 rivers and identifies innovative management agreements.

The CLE will discuss the intricate and complex laws related to "water" and the various tools used to manage international waters. The CLE provides an excellent entry point and introduction to this area of law.

Attendees at this interesting CLE will gain an understanding of the following:

- An overview of laws & regulations pertaining to international law.
- A comparative analysis of the differences & similarities between various treaties dealing with international water law.

Speaker:
Daniel Seligman is an attorney-at-law and the principal in the Columbia Research Corp., an energy/water/natural resources consulting company in Seattle.

Dan is the primary author of two studies published by the Colorado River Commission of Nevada, Laws of the Rivers (an examination of the legal regimes of major interstate rivers in theUnited States)(2006) and World's Major Rivers (an introduction to international water law with case studies)(2008). Both studies are available for no cost on the Commission web site, http://crc.nv.gov/index.asp?m=wat.

Dan's presentation will focus on international water law and the results of the World's Major Rivers study.

The State of the Vatican

Vatican City is widely known as the center of the Roman Catholic faith, and the home of the Pope. However, Vatican City is also the world’s smallest sovereign state, with the Pope its head of state. Rare in the modern world, it is a non-hereditary monarchy. As both a sovereign state among international peers, and the home of one of the world’s great religions, Vatican City brings great political influence to bear on world events and world leaders, quite apart from its spiritual role for Catholics. It holds property worldwide and operates its own secret service. Knowledge of the State of the Vatican City, its constitutional system and political position is of great interest to the international lawyer. Mark your calendars for this interesting insight!

* Ms. Julie Wade, in-house counsel for Starbucks, discusses some of the ways she has helped develop and implement socially responsible programs.

As globalization increases, more and more U.S companies are engaging in cross border operations and transactions. One such local homegrown multinational company is of course Starbucks. Today, Starbucks is a universal brand and recognized throughout the world not only for its coffee, but for its social consciousness. This is apparent by the practices and programs it espouses, including the Coffee and Farmer Equity (CAFÉ) Practices program, its cocoa sourcing program known as “Cocoa Practices,” its manufactured goods and services sourcing program known as the “Supplier Social Responsibility” program as well as its involvement in the LEED Green Building Programs throughout the world.

* Mr. Chang Wang
Chang Wang is an associate professor of law at School of American and Comparative Law, China University of Political Science and Law. He is also a consultant with Thomson Reuters Legal, for whom he has been working on business development in China since 2005. He is lead advisor to TRL’s China Academic Programs and a board member of the Hildebrandt China Law Conference. Most recently, he has been working on the Westlaw China project.

In China, Mr. Wang is a member of the Central Civil and Judiciary Committee of China Association for Promoting Democracy, the fourth largest political party in the Mainland. He writes extensively, in English and Chinese, on constitutional law, legal research, intellectual property, critical theory, and film history, and his articles appear in leading Chinese legal and art journals. In addition to teaching legal research at China University of Political Science and Law, Mr. Wang speaks frequently at top law schools and government agencies in China on the rule of law and legal research.

In the U.S., Mr. Wang serves on the China Steering Committee of American Bar Association and the Advisory Board of the University of Minnesota China Art Program.

Mr. Wang received his B.F.A. in Film Studies from Beijing Film Academy in 1995; an M.A. in Comparative Literature and Comparative Cultural Studies from Peking (Beijing) University; an M.A. in American Art History from University of Illinois at Urbana-Champaign; and his Juris Doctor from the University of Minnesota Law School. He has been admitted into practice in Minnesota, the District of Columbia, and federal courts.

The attorney-client privilege in the age of globalization presents interesting and complex issues.

This CLE is designed to:

Provide an overview of attorney-client privilege issues that arise during international arbitrations and e-discovery in an international context.
Examine the differences between the privilege in the United States and in the European Union.
Attendees will apply the concepts learned via an interactive discussion of hypotheticals.

LLC will discuss privilege and e-discovery issues that arise during international arbitrations.
* Nadja Vietz of Harris & Moure will discuss a recent landmark decision of the European Union Court of First Instance, regarding the attorney-client privilege and the status of in-house counsel. n She will also compare EU law with German law.
* Helen Moure of K&L Gates will discuss e-discovery issues in an international context, such as preventative measures, what to do when privileged information is acquired by another party through e-discovery, and the impact of waiving the privilege abroad.
* Professor David Boerner of the Seattle University School of Law will discuss hypotheticals incorporating the concepts above.
